A whistleblower lawsuit against the Allentown Police Department by two of its officers will return to court Dec. 31.

The suit, filed by officers Randy Fey and David Howells III over the summer, claims the police department didn’t properly resolve allegations against other officers that included sexual assault, discrimination, use of their positions to receive sexual favors from women involved with prostitution and drugs, and falsification of documents.

Lehigh County Judge Zachary Cohen dismissed the suit Oct. 21 because the court had not received the plaintiffs’ response to preliminary objections by the city’s attorneys.

The plaintiffs’ attorney, Dennis Charles, said the response was submitted Oct. 13 but did not go into the system because of a filing error. He asked the court to reconsider the dismissal.

Cohen on Oct. 30 agreed to reinstate the suit and scheduled the new hearing for 10 a.m. Dec. 31.
